	TERMS AND CONDITIONS 1. The person submitting the demo material, hereinafter referred to as the Author, declares that he or she is the creator, author, composer and performer of the musical work or works submitted, authorizing Picap SL to disseminate and / or publish it or them in any media and on any support that Picap SL may deem necessary. 2. The Author grants Picap SL all commercial rights for the musical work or works with no remuneration, and in particular including, but not limited to the following rights: reproduction, distribution and public relations for said work or works, entitling and authorizing PICAP SL to grant third parties these rights should this be deemed necessary for its / their dissemination and / or publication via Internet or other media. In any case, the Author permits Internet users to obtain copies of the musical work or works for personal use, exonerating Picap SL of all responsibility for any undue use of the said musical work or works by Internet users that may arise. 3. The musical work or works is / are free of charges and encumbrances, as well as third party rights, especially rights held by the various management companies (for instance SGAE, GEMA, BVL and the like). Should the Author submitting the musical work or works belong to any of these management organizations, he or she shall inform Picap SL. 4. The musical work or works shall be submitted to Picap SL as an audio file or files (MP3 file format or any other file format requested by Picap SL). This musical work or works shall be disseminated and published with no changes nor modifications whatsoever, whereby the identity of its Author shall always be indicated via his or her name, signature or a sign that identifies him or her. 5. The commercial rights to the musical work or works shall be granted for a limited time period to be indicated by the Author. Upon the Author's request, Picap SL shall delete the musical file or files from the server within a maximum of 60 days. 6. Picap SL reserves the right not to proceed to the dissemination and publication of the musical work or works. 7. The Author guarantees that his or her work or works does / do not violate any intellectual or industrial property rights, or any other rights that a third party may hold over the musical work or works and commits to comply with any applicable regulations regarding intellectual and industrial property rights and image rights, as well as the penal and administrative legislation in effect at any given time. 8. The Author declares that he or she has read the present Terms and Conditions, understands them and accepts all the terms and conditions contained herein before submitting the musical file or files. The Author was informed of these Terms and Conditions through the Picap SL website or other means. 9. The fees applicable to the services governed by this contract shall be notified in writing to the Author, i.e. the individual having submitted his or her musical work or works, with the corresponding approval by said Author annexed to this contract and invoice. 10. The Author waives his or her right to disagree or object to any or all of the clauses in this contract once he or she has submitted the musical work or works to Picap SL.
